    Chapter I General Provisions

Article 1 In order to regulate the procedures of the Standing Committee of the Loudi Municipal People's Congress (hereinafter referred to as the Standing Committee), improve the efficiency of deliberations, and ensure that the Standing Committee performs its duties in accordance with the law, in accordance with the Constitution of the People's Republic of China and the People's Representatives at Local Levels of the People's Republic of China The Organizing Law of the General Assembly and local people's governments at various levels, the Supervision Law of the Standing Committees of the People's Congresses at all levels of the People's Republic of China, the Legislative Law of the People's Republic of China, the Supervision Law of the People's Republic of China, and other relevant legal provisions, This rule.

Article 2. The Standing Committee is the permanent organ of the Municipal People's Congress and is responsible to the Municipal People's Congress and reports on its work. The Standing Committee conducts its work in accordance with statutory powers and procedures and exercises its powers collectively.

Article 3 The Standing Committee implements democratic centralism. To consider bills and decide on major issues, democracy should be fully promoted and the democratic rights of members of the Standing Committee should be guaranteed.

Article 4 The meeting of the Standing Committee is held in public. The meeting was reported through the media. The meeting of directors of the Standing Committee (hereinafter referred to as the meeting of directors) has decided that some may be held in private.

 

Chapter II Powers of the Standing Committee

Article 5 The Standing Committee presides over the election of deputies to the Municipal People's Congress.

The Standing Committee shall, as required, notify the relevant electoral units of the deputies who have been vacated by-elections or additional individual representatives within the number of deputies of the Municipal People's Congress.

The Standing Committee establishes a Representative Qualifications Review Committee to review the qualifications of deputies to the Municipal People's Congress and asks the Standing Committee for confirmation.

Article 6 During the intersessional period of the Municipal People's Congress, the Standing Committee will make by-elections of vacancies in the Provincial People's Congress and remove individual representatives. At the joint meeting of the directors' meeting or the standing committee, more than one-fifth of the members may submit to the standing committee the removal of individual representatives of the provincial people's congresses elected by this city. After consideration of the meeting of the Standing Committee of the dismissal case, the meeting of directors shall request the plenary to vote.

Article 7 The Standing Committee shall convene a meeting of the Municipal People ’s Congress in accordance with the law. Generally, the Municipal People ’s Congress shall notify the representatives of the Municipal People ’s Congress one month before the meeting of the Municipal People ’s Congress and the main matters recommended for discussion.

Article 8 The Standing Committee exercises the power to formulate local regulations in accordance with the law.

Article 9 The Standing Committee discusses and decides on major issues in politics, economy, education, science, culture, health, environment and resource protection, civil affairs, nationality, and overseas Chinese affairs within its administrative area.

Article 10 The following major matters in this administrative area shall be submitted to the Standing Committee for consideration and corresponding resolutions and decisions shall be made.

(1) Major measures to implement the Constitution, laws, regulations and resolutions and decisions of the people's congresses at higher levels and their standing committees and people's congresses at the corresponding levels;

(2) Important decisions and arrangements for advancing the administration of the city according to law, strengthening socialist democracy and the construction of the rule of law;

(3) Development plans for education, science, culture, health, and sports;

(4) Partial changes to the annual plan for national economic and social development;

(5) Partial changes to the city's annual fiscal budget;

(6) The city's annual financial accounts;

(7) Major measures involving population, environment, and resources;

(8) Adjustment of administrative divisions, change of administrative area names, and relocation of government offices;

(9) Matters brought to the decision of the Procurator of the People's Procuratorate for disagreeing with the decision of the majority of the Procuratorate on major issues;

(10) Deciding to grant or revoke local honorary titles;

(11) Determine matters such as city-wide festivals, anniversaries, city trees, and city flowers;

(12) establishing friendly relations with foreign local governments;

(13) Major matters referred to the Standing Committee by the Municipal People's Congress for consideration and decision;

(14) Major matters recommended by the Standing Committee of the Loudi Municipal Committee of the Communist Party of China;

(15) Other major matters that the Municipal People's Government requests or the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate recommend to the Standing Committee for consideration and decision;

(16) Other major matters stipulated by laws and administrative regulations to be considered and decided by the Standing Committee.

Article 11 The following major matters within the administrative region shall be reported to the Standing Committee, which may make opinions, suggestions or make resolutions and decisions:

(1) the implementation of the national economic and social development plan;

(2) Development planning and implementation of major social and people's livelihood undertakings;

(3) the implementation of the municipal budget;

(4) Auditing of the implementation of the municipal budget and other fiscal revenues and expenditures;

(5) the use and management of non-tax income;

(6) the rectification of problems found in the audit;

(7) Performance management of financial budget funds at the corresponding level;

(8) The mid-term assessment of the five-year plan for national economic and social development;

(9) the revision, change and implementation of the overall land use plan, the urban system plan and the city-level urban plan;

(10) The annual investment plan and some changes of the municipal government;

(11) Major adjustments to the price standards of public utility services related to people's livelihood;

(12) Management of state-owned assets of the Municipal People's Government;

(13) the formulation and implementation of ecological environment planning;

(14) Annual environmental conditions and achievement of environmental protection goals;

(15) Development and utilization of major rivers such as "Four Waters and Three Reservoirs" (ZiShui, Lianshui, Sunshui, Shuishui, Shuifumiao Reservoir, Baima Reservoir, Shuangjiang Reservoir) and their environmental protection;

(16) Major public emergencies that caused serious losses to the state, collective property, and citizens' lives and property, and how to deal with them;

(17) The protection planning and implementation of key scenic spots, historical relics and natural reserves, national parks, etc. at the municipal level and above;

(18) Other major matters that the Municipal People's Government, Municipal Supervisory Committee, Municipal Intermediate People's Court and Municipal People's Procuratorate deem necessary to report;

(19) Other important matters required by laws and administrative regulations to be reported to the Standing Committee.

Article 12 If the Municipal People's Government violates the Constitution, laws, or administrative regulations and makes decisions on major matters, the Standing Committee shall revoke its decisions in accordance with law.

Article 13 The Standing Committee revokes inappropriate resolutions and decisions of the Municipal People's Government, County (City, District) People's Congress and its Standing Committee according to law.

Article 14 The Standing Committee supervises the work of the Municipal People's Government and its departments, the Municipal Supervision Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate according to law. The main forms of supervision are:

(1) Hearing and reviewing special work reports, putting forward suggestions, criticisms and opinions, and making corresponding resolutions and decisions when necessary;

(2) To review and document the regulatory documents formulated by the Municipal People's Government; to revoke inappropriate decisions and orders of the Municipal People's Government according to law;

(3) In accordance with the provisions of the law, it is decided to revoke the posts of staff members of state organs who have seriously violated the law and discipline and dereliction of duty;

(4) Organizing an investigation committee on specific issues and making corresponding resolutions and decisions based on the report of the investigation committee;

(5) to supervise the performance of the staff elected and appointed by the Municipal People's Congress and the Standing Committee;

(6) To accept the complaints and opinions of the people on the above-mentioned organs and state staff, instruct the relevant departments to handle them seriously, report the results within a time limit, and supervise the important complaint cases that are strongly reflected by the people;

(7) During the meetings of the Standing Committee, inquiries and inquiries shall be made to the above-mentioned state organs in accordance with the law;

(8) To organize inspections by members of the Standing Committee and representatives of the Municipal People's Congress;

(9) Examine the implementation of the Constitution, laws, administrative regulations, and local regulations, and urge relevant agencies to deal with illegal issues.

Article 15 The Standing Committee exercises the power of appointment and removal according to law:

(1) During the intersessional period of the Municipal People's Congress, when the mayor, the director of the Municipal Supervisory Committee, the president of the Municipal Intermediate People's Court, and the chief procurator of the Municipal People's Procuratorate cannot hold office for any reason, the acting mayor is decided from among the deputy leaders of the aforementioned organ Candidates for Acting Director, Acting Dean and Acting Prosecutor;

(2) during the intersessional period of the Municipal People's Congress, decide on the individual appointment and removal of the deputy mayor;

(3) On the nomination of the mayor, decide on the appointment and removal of the secretary-general, committee director, and director of the Municipal People's Government;

(4) Supplemental appointment of individual deputy directors and some members of special committees based on the nomination of the directors 'meeting; based on the proposal of the directors' meeting, decide to revoke or remove the positions of individual deputy directors and some members of the special committees, and next time Report of the Municipal People's Congress;

(5) On the nomination of the director, decide to appoint and remove the deputy secretary-general of the standing committee, the director and deputy director of the working committee (such as the working committee), the standing committee office, the election appointment and removal liaison working committee, the research office, and the budget working committee;

(6) Appointment and removal of deputy directors and members of the Municipal Supervision Committee on the nomination of the director of the Municipal Supervision Committee;

(7) On the nomination of the President of the Municipal Intermediate People's Court, appoint and remove the Vice President, President (Secretary), Deputy President (Deputy Director), members of the Judicial Committee, and judges of the Municipal Intermediate People's Court;

(8) On the nomination of the Procurator-General of the Municipal People's Procuratorate, the Deputy Procurator-General of the Municipal People's Procuratorate, a member of the Procuratorial Committee, and the Prosecutor shall be approved and appointed the Procurator-General of the County, City, and District People's Procuratorate.

Article 16 During the intersessional period of the Municipal People's Congress, it is decided to revoke the positions of individual deputy mayors; it is decided to revoke the other members of the municipal people's government appointed by it and the deputy directors and members of the municipal supervision committee, the deputy president of the municipal intermediate people's court, Posts of the President (Secretary), Deputy President (Deputy Director), members of the Judicial Committee, judges, deputy procurators of the Municipal People's Procuratorate, members of the Procuratorial Committee, and prosecutors.

Article 17 When the director of the Standing Committee is unable to work or is absent due to health conditions, the Standing Committee shall select one of the deputy directors to act as the deputy director until the director is restored to health or the municipal people's congress elects a new director. During the intersessional period of the Municipal People's Congress, the Standing Committee decided to accept proposals from the mayor, deputy mayor of the Municipal People's Government, members of the Standing Committee, members of the special committees, the director of the Municipal Supervision Committee, the president of the Municipal Intermediate People's Court, and the chief procurator of the Municipal People's Procuratorate. Resign and report to the next Municipal People's Congress. After accepting the resignation of the procurator of the Municipal People's Procuratorate, the Municipal People's Procuratorate must report to the Provincial Procuratorate of the Provincial People's Procuratorate for the approval of the Standing Committee of the Provincial People's Congress.

Article 18 During the intersessional period of the Municipal People's Congress, with the permission of the Non-Standing Committee, the representatives of the Municipal People's Congress are not subject to arrest or criminal trial. If other legal restrictions on personal freedom are adopted, they should be reported to the Standing Committee for permission. If detained because of an existing offender, the public security organ performing the detention should immediately report to the Standing Committee.

  

Chapter III Convening of Meetings

Article 19 The standing committee meeting shall be convened and chaired by the director of the standing committee. The director may entrust the deputy director to chair the meeting.

Article 20 The meeting of the Standing Committee shall be held at least once every two months. In special circumstances, a meeting may be convened temporarily.

Article 21 A meeting of the Standing Committee must be attended by more than half of all members of the Standing Committee. During the meeting of the Standing Committee, members of the Standing Committee must attend the meeting except for leave due to illness or other special reasons with the consent of the convener of the meeting.

Article 22 The agenda of the Standing Committee meeting shall be determined according to the following procedures:

(1) One month before the meeting, the Secretary-General makes recommendations to the meeting of directors in accordance with the main points of the work plan of the Standing Committee and important opinions of relevant parties;

(2) The meeting of directors prepares a draft agenda;

(3) Adopted by the Standing Committee.

(4) If the agenda needs to be adjusted during the meeting of the Standing Committee, it shall be proposed by the meeting of directors and agreed by the plenary meeting of the Standing Committee.

Article 23 A standing committee meeting shall notify all members of the standing committee and relevant attendees of the meeting date and the main matters proposed for discussion at the meeting 20 days before the meeting is held. Ad hoc meetings may be notified on an ad hoc basis.

Article 24 When the Standing Committee holds a meeting, the mayor or deputy mayor of the Municipal People's Government, the director or deputy director of the Municipal Supervisory Committee, the president of the Municipal Intermediate People's Court, and the chief procurator of the Municipal People's Procuratorate shall attend the meeting. The heads of the special committees of the Municipal People's Congress (hereinafter referred to as the special committees) who are not members of the standing committee, the deputy secretary-general of the standing committee, the working bodies of the standing committee, and other relevant department heads attended the meeting.

The director or deputy director of the county and city people's congress standing committee attended the meeting.

According to the needs of the meeting agenda, the person in charge of relevant departments of the Municipal People's Government, representatives of the Municipal People's Congress, representatives of the Provincial People's Congress elected by this Municipality, and other relevant personnel may be invited to attend the meeting.

The Standing Committee meeting may set up an auditorium, and citizens of this city (except those deprived of political rights) who have reached the age of 18 and have full capacity for civil conduct may apply to attend the Standing Committee meeting.

The mayor or deputy mayor of the municipal people's government attending the meeting, the director or deputy director of the municipal supervisory committee, the president of the municipal intermediate people's court, the chief procurator of the municipal people's procuratorate, and the chief executive of the relevant department of the municipal people's government need leave, due to special circumstances. With the consent of the convener of the meeting, other relevant persons in charge may be arranged to attend the meeting. If the person in charge of "one government, one committee and two houses" absent from a standing committee meeting without approval, the director of the standing committee will speak; if the principal person in charge of the municipal people's government functional department absent from a standing committee meeting without approval, the person in charge or in charge shall The deputy director of the Standing Committee spoke. If an attendee is absent twice from the Standing Committee without approval within one year, the Standing Committee will be held accountable according to law.

Article 25 Before the Standing Committee meets, the members of the Standing Committee, the Municipal People's Government, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, the Municipal People's Procuratorate and relevant departments shall make full preparations according to the draft agenda prepared by the meeting of directors. The committees and working agencies shall make necessary investigations and researches on issues and form investigation reports.

Article 26 When a meeting of the Standing Committee reviews a bill or related work report, it may notify the people in charge of the Municipal People ’s Government, the Municipal Supervisory Committee, the Municipal Intermediate People ’s Court, the Municipal People ’s Procuratorate and relevant departments to hear opinions.

  

Chapter IV Proposal and Review

Article 27 The meeting of directors may submit to the standing committee at the corresponding level a bill that falls within the scope of the power of the standing committee, and is considered by the standing committee meeting. The directors' meeting may entrust relevant special committees and working bodies to draft relevant bills and make explanations to the meetings of the standing committee.

The special committees of the Municipal People's Government and the Municipal People's Congress may submit proposals to the Standing Committee that fall within the purview of the Standing Committee, which is decided by the meeting of directors and submitted to the Standing Committee for consideration, or submitted to the relevant special committees for review, report, and decision. The meeting of the Standing Committee for deliberation; or the relevant working organization shall be entrusted to conduct a preliminary review, and then it shall be decided to submit the meeting to the Standing Committee for deliberation.

Members of the Standing Committee consisting of five or more members can submit proposals to the Standing Committee at the corresponding level within the scope of the Standing Committee's competence. The meeting of directors decides whether to submit the meeting to the Standing Committee for review, or submits it to the relevant special committee for review, submits a report, and then decides. Whether to submit the meeting to the Standing Committee for review; or to entrust the relevant working organization to conduct a preliminary review before deciding whether to submit it to the Standing Committee meeting for review.

The director's meeting decides not to submit the motion to the Standing Committee for consideration, and it should be explained to the sponsor.

A motion jointly proposed by the meeting of the directors of the Standing Committee, the Municipal People's Government, the special committees of the Municipal People's Congress, and the members of the Standing Committee shall be submitted in writing 15 days before the meeting of the Standing Committee. Signature of the principal or sponsor, and send it to the Standing Committee Office.

Article 28 Personnel appointment and dismissal cases submitted for consideration by the Standing Committee shall be submitted to the written report signed by the official leaders of the organ. Those who apply for the post must be accompanied by the prospective personnel's inspection materials, resumes, reasons for appointment, and legal knowledge examination; if they are requested to be removed, they must have the statement of removal.

For the case of revocation of a post submitted to the Standing Committee for consideration, the organ or person making the request shall state in writing the reasons for the proposed revocation.

Article 29 When a bill is considered at a meeting of the Standing Committee, the organ that proposes the bill shall provide relevant materials, and send someone to the meeting to hear the review opinions and answer questions.

Article 30 If the proposal is withdrawn before the vote is placed on the agenda of the meeting of the Standing Committee, the approval of the meeting of the directors shall terminate the consideration of the proposal.

Article 31 If a bill that is included in the agenda of a standing committee meeting requires further verification and research during the review, the director or the meeting of the directors may propose the proposal and the standing committee meeting may agree not to vote for the time being and submit the relevant special The committee deliberates or the relevant working organization studies and submits a report, which is then submitted to the Standing Committee for consideration and voting.

Article 32 When the Standing Committee considers it necessary, it may organize an investigation committee on specific issues, and make corresponding resolutions based on the report of the investigation committee.

Article 33 A motion passed at a meeting of the Standing Committee and making a resolution shall be announced to the public.

  

Chapter V Hearing and Review of Special Work Reports

Article 34 Each year, the Standing Committee selects a number of major issues that have a bearing on the overall interests of reform, development, stability, and the immediate interests of the people, and are generally concerned by the society. Special work reports of courts and municipal people's procuratorates.

The Standing Committee listens to and reviews reports on national economic and social development plans, budget execution and budget adjustments, listens to and reviews audit work reports, reviews and approves final accounts. Except for special provisions in the Supervision Law and Budget Law, it refers to special work for hearing and review. Reported procedure execution.

The Standing Committee may inspect the implementation of laws and regulations in its administrative area according to the needs of its work. After the law enforcement inspection is over, the law enforcement inspection team shall promptly submit a law enforcement inspection report, which is decided by the meeting of directors and submitted to the Standing Committee for consideration.

Article 35 The work reports submitted to the Standing Committee by the Municipal People's Government and its working departments, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate shall be submitted by the Mayor or Deputy Mayor of the Municipal People's Government, and the Municipal People's Government Work Department. The person in charge of the administrative post, the director or deputy director of the Municipal Supervisory Committee, the president of the Municipal Intermediate People's Court, and the chief procurator of the Municipal People's Procuratorate reported to the meeting. If the person in charge of the post is vacant, the person in charge of the meeting may report to the meeting with the consent of the convener of the meeting.

Article 36 After the Standing Committee meeting has heard and reviewed the work report, the relevant special committee or the working committee of the Standing Committee summarizes the review opinions of the members of the Standing Committee, and submits them to the Standing Committee's Office in the form of "Reviews of the Standing Committee." The Municipal People's Government, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate shall study and handle the matter. The Municipal People's Government, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate must report to the Standing Committee in writing within the prescribed time limit. When the Standing Committee deems it necessary, it may make a decision on the special work report or law enforcement inspection report.

The special work report or law enforcement inspection report and review opinions heard by the Standing Committee, and the report of the Municipal People's Government, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate on the review and handling of the review opinions or the implementation of the resolutions, to the Municipal People's Congress representative Notification and announcement to the public.

Article 37 The Municipal People's Government, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate shall send their special work reports to the relevant special committees of the Municipal People's Congress before their meetings of the Standing Committee, or The relevant working bodies of the Standing Committee solicit opinions. The office of the Standing Committee shall send a special work report or inspection report on enforcement to the members of the Standing Committee seven days before the meeting of the Standing Committee.

Article 38 When the Standing Committee meeting considers a special work report or a law enforcement inspection report, the person-in-charge of the relevant organ shall attend the meeting to hear the deliberations.

Article 39 The Standing Committee implements satisfaction assessment and voting on special work reports. Satisfaction assessment consists of three levels of satisfaction, basic satisfaction, and dissatisfaction. Satisfaction votes exceed 50% of all members, and satisfaction and basic satisfaction votes reach 80% of all members. Satisfaction is satisfied; satisfaction and basic satisfaction votes exceed all 50% of the constituents are basically satisfied; if the satisfaction and basic satisfaction votes are below 50% (including 50%), they are not satisfied.

If the special work report is evaluated as unsatisfactory, the reporting agency must conscientiously rectify it within 2 months and make a supplementary report or re-report at the next Standing Committee meeting; if the report is still unsatisfactory, the Standing Committee may initiate supervision procedures according to law Investigate the responsibilities of relevant personnel.

  

Chapter VI Inquiries and Questions

Article 40 When the Standing Committee meeting considers proposals and related reports, the Municipal People's Government or relevant departments, the Municipal Supervisory Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate shall send relevant personnel to the meeting, listen to opinions, and answer questions.

Article 41 The Standing Committee selects important deployments or major issues related to the overall economic and social development of the city, as well as the outstanding problems of "one house, one committee and two houses", which are generally concerned by the society, reflected by the masses, or urgently need to be resolved. Article 42 The joint members of the Standing Committee of five or more persons may submit a written inquiry to the Standing Committee of the Municipal People's Government and its work department, the Municipal Supervision Committee, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate.

Article 43 An inquiry case must specify the object of inquiry, the question and content of the inquiry.

Article 44 If the questioning case is requested to be withdrawn before the questioning authority responds, the questioning shall be terminated.

Article 45 The inquiry case shall be decided by the meeting of directors and passed to the questioned organ. The person in charge of the questioned organ shall reply orally at the plenary meeting of the Standing Committee or the relevant special committee meeting, or the written answer of the questioned organ. In response to the meeting of the special committee, the members of the standing committee that raised the inquiry should attend the meeting and express their opinions. If the question is answered orally, the person in charge of the questioning authority shall answer it at the meeting. A written reply shall be signed by the person in charge of the questioning authority and printed and distributed to all members of the Standing Committee by the meeting of directors.

If the answer to a question is taken by secret ballot, if more than one-third of the members of the Standing Committee are not satisfied with the answer to the question, the questioned organ shall make a reply again.

  

Chapter VII Evaluation of Special Work

Article 46 The Standing Committee may organize special work appraisals for the municipal people's government working departments, directly-affiliated working institutions and other administrative law enforcement departments within the administrative area, the municipal supervision committee, the municipal intermediate people's court, and the municipal people's procuratorate. Representatives of the People's Congress participated in the review.

The unit to be evaluated and the matters to be evaluated are determined by secret ballot of members of the Standing Committee.

Article 47 The evaluation of special work is carried out at the meeting of the Standing Committee.

Article 48 The Standing Committee may, as required, organize the deputies of the People's Congress and relevant special committees and working institutions to investigate the relevant situation of the unit under review. Article 49 In the evaluation council, the person in charge of the administrative chief of the unit being evaluated shall make a work report in accordance with the evaluation requirements, listen to opinions, and answer queries. Article 51 A review opinion shall be formed after the review. Chapter IX Supplementary Provisions
